Tampa Police make arrest in fatal crash on Dale Mabry Highway

On Monday, June 3, 2024, at approximately 10:25 a.m., Tampa Police officers responded to a two-vehicle crash at N Dale Mabry Hwy and W South Ave intersection.

Upon arrival, officers found two victims in a 2015 Nissan Versa. The passenger, a female in her early 60s, had life-threatening injuries, and the driver, a male in his early to mid-70s, had non-life-threatening injuries. Both were transported to a local hospital, where the passenger later died. The driver remains hospitalized in stable condition.

22-year-old Andy Moya Robaina was driving a 2011 BMW 335i and reported no injuries. He stayed at the scene after the incident.

Investigators determined Robaina was traveling southbound on N Dale Mabry Hwy at a high speed alongside another vehicle that appeared to be racing. As the victim’s vehicle crossed N Dale Mabry Hwy near W South Ave, Robaina’s vehicle struck it from the inside lane. Robaina’s vehicle stopped in the northbound lanes of N Dale Mabry Hwy.

The other vehicle, believed to be dark-colored, narrowly missed the Nissan and continued southbound on N Dale Mabry Hwy without stopping.

Robaina was taken into custody and transported to Orient Road Jail. He was charged with one felony count of Vehicular Homicide and one misdemeanor count of Unlawful Racing on a Highway.

During the investigation, both southbound and northbound lanes of N Dale Mabry Hwy were closed between W Hillsborough Ave and W MLK Blvd but have since reopened.

Investigators are working to identify the driver of the dark-colored vehicle. Anyone with information is encouraged to call the Tampa Police non-emergency number at 813-231-6130 or submit an anonymous tip via Crime Stoppers of Tampa Bay at 800-873-TIPS (8477) or via Tip411.

The investigation is ongoing.
